Determining Parental Rights In Indiana

It is preferable to establish paternity within the first few days of the birth of a child in Indiana. This is especially true for couples who are not married and need to provide their child with significant legal benefits and rights, such as a clear identity, a birth certificate, financial support, inheritance rights, life insurance and health insurance and medical care.

 

If a woman is married when she gives birth, her husband is assumed, by law, to be the father of the child. If a woman has been unmarried for less than 10 months due to a divorce or the death of her husband, her husband at the time of conception is assumed to be the father. If a woman was not married at the time of conception or time of birth, then paternity must be determined through genetic testing.

Legal action must be taken to have a genetic test performed to establish paternity. This is done through hospital affidavits, administrative affidavits or court determinations.
