Dividing property in Indiana is not as simple as assessing the cash value of property and dividing it equally between each party. While each party may be able to claim ownership over property that he or she acquired separately prior to marriage, any property acquired during a marriage is considered marital property, and is subject to what the court deems "equitable division of assets."

It is preferable for divorcing couples to work out agreements outside of the courtroom, where they can retain more control over the decisions made regarding property. Still, not all cases can be handled in such a way.
